California law prohibits landlords from discriminating against tenants based simply on the fact that they receive a Section 8 voucher. The law also prohibits discrimination against tenants who receive a Veterans Affairs Supportive Housing (VASH) voucher. The law generally prohibits landlords from doing any of the following based on the fact that the tenant is using a voucher:

  • Refusing to enter into a tenancy.
  • Falsely representing that a unit is not available for inspection or rent.
  • Including different clauses, conditions, or restrictions in the rental agreement.
  • Terminating or interrupting a tenancy.

These laws also generally prohibit advertising, in any form, that indicates discrimination based on a person’s source of income. This means that properties cannot state “No Section 8” or state other source of income-based preferences in their advertisements.
